Welcome to FODCAM! This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our mobile application, website, and related services (collectively, the “Service”). Capitalized terms not defined here have the meanings in our Terms of Service.


1. Information We Collect

No Sensitive Inference

We do not intentionally collect or infer sensitive personal data such as racial or ethnic origin, health conditions, or religious beliefs.


2. How We Use Your Information

  1. Provide the Service. Process food images, generate AI results, display them to you.
  2. Improve & Secure. Monitor performance, detect fraud/abuse, debug and enhance features.
  3. Billing & Administration. Manage subscriptions, send transaction receipts, handle refund requests.
  4. Analytics. Aggregate usage statistics via Amplitude to understand feature popularity and retention.
  5. Communications. Send in-app messages or emails about critical updates, security alerts, or policy changes.
  6. Legal Compliance. Fulfill legal obligations, enforce our Terms, protect rights and safety.

We do not sell your personal information or share it with advertisers.


3. Third-Party Processing & Disclosure

We share data only with service providers who help us run FODCAM, under contractual obligations to protect it:

We may also disclose information to governmental authorities when required by law or to defend legal claims.


4. Data Storage & Retention

  • User Images: Stored on our servers for up to 24 hours to ensure successful processing, then permanently deleted. AI copies at OpenAI expire after 30 days.
  • Account Data: Retained while your subscription is active and for up to 90 days after cancellation, unless a longer period is required by law (e.g., tax records).
  • Analytics & Logs: Aggregated or de-identified after 12 months.

5. Your Rights & Choices

A. California Consumer Privacy Act (CCPA)

California residents may:

  1. Request access to categories and specific pieces of personal information we hold.
  2. Request deletion of personal information (subject to exceptions).
  3. Opt out of "sale" or "sharing" of personal information (we do not sell or share as defined by CCPA).

B. General Data Protection Regulation (GDPR)

If you are in the EEA, UK, or Switzerland, you may have rights to access, correct, delete, or restrict processing of your personal data and to data portability. Our legal bases include performance of a contract (Terms), legitimate interests (improving Service), and consent (where applicable).

C. Data Deletion

You may delete your account and associated data at any time via in-app settings or by emailing [email protected].


6. International Data Transfers

We are based in the United States. By using the Service, you consent to transferring your data to the U.S. and other jurisdictions that may not provide equivalent data-protection laws. We rely on Standard Contractual Clauses for transfers from the EEA/UK.


7. Security Measures

We use industry-standard encryption in transit (TLS 1.2+) and at rest, access controls, and periodic security audits. No method is 100% secure, so we cannot guarantee absolute security.


8. Children's Privacy

FODCAM is not directed to children under 13, and we do not knowingly collect personal information from them. If we learn a child under 13 has provided data, we will delete it.


9. Changes to This Policy

We may update this Privacy Policy. We will post the new version in-app and notify you at least 14 days before material changes take effect. Your continued use after the effective date means you accept the revisions.
