PLEASE READ THESE TERMS CAREFULLY. By downloading, installing, or using the FODCAM mobile application (the “App”) or any related services provided by Aidan Dunlap (collectively, the “Service”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, do not access or use the Service.
These Terms constitute a legally binding agreement between you and Aidan Dunlap ("FODCAM," "we," "us," or "our"). You must be at least 13 years old to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian.
FODCAM allows you to capture photographs of food and submit them to an artificial-intelligence model hosted by OpenAI (currently GPT-4.1) for analysis, such as nutrient estimation. OpenAI retains submitted data for up to 30 days for abuse monitoring and will not use it to train its models.
You may need an account to access certain features. You agree to provide accurate information and to keep it updated. You are responsible for all activity under your account.
FODCAM offers paid features via Apple App Store and Google Play in-app purchases processed through RevenueCat. Prices and billing cycles are disclosed in-app. All purchases are final except as required by applicable platform policies or law. You authorize the platform to charge fees to your payment method.
We rely on third-party providers, including OpenAI, RevenueCat, and Amplitude, to operate the Service. Their terms and privacy policies govern your use of their services, and we are not responsible for their acts or omissions.
Information returned by the Service is provided for informational purposes only and is not medical, nutritional, or professional advice. AI outputs may be inaccurate or incomplete. You assume all risk arising from reliance on such outputs, and we disclaim all liability for decisions you make based on them.
The Service and all related software, text, graphics, and other content (excluding User Content) are owned by or licensed to FODCAM and are protected by intellectual-property laws. We grant you a personal, non-transferable, revocable license to use the App solely as permitted in these Terms.
If you provide feedback, you grant us a perpetual, royalty-free license to use it without restriction.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIDCAM'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) US $50 OR (B) THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM AROSE. WE WILL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY.
You agree to defend, indemnify, and hold harmless FODCAM and its affiliates from any claims, damages, or expenses arising out of your use of the Service or violation of these Terms.
PLEASE READ THIS SECTION CAREFULLY. Any dispute arising under these Terms will be resolved by binding arbitration administered by the American Arbitration Association in San Francisco County, California. You waive any right to participate in a class or representative action.
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles.
We may modify these Terms. We will post changes in-app and provide at least 14 days' notice before they take effect. Continued use after the effective date constitutes acceptance.
We may suspend or terminate your access at any time for violation of these Terms or to protect the Service. Sections 7-14 survive termination.
If any part of these Terms is unenforceable, the remainder stays in effect. Our failure to enforce any right is not a waiver.
